Court dismisses Kazombo’s bid for judicial review against MEC

The High Court in Lilongwe has dismissed an application by former Deputy Speaker of Parliament, Madalitso Fred Kazombo, who sought permission to commence judicial review proceedings against the Malawi Electoral Commission (MEC).

Kazombo had petitioned the court to challenge MEC’s handling of the just-concluded elections, whose results are yet to be officially announced.

However, presiding Judge Violet Palikena-Chipao ruled that the application was riddled with irregularities and errors, including typographical mistakes, unclear arguments, and compounded facts.

The court observed that the documents appeared to have been prepared in haste and without sufficient supporting evidence, making it difficult to appreciate the applicant’s arguments.

As a result, the judge dismissed the application but granted Kazombo the liberty to refile a properly drafted case.

Should he decide to proceed, the court ordered that any fresh application must be served on MEC to allow the Commission to respond.
