High Court to hear injunction case against MEC’s voter registration rules

The High Court in Blantyre is set to hear an application this afternoon from five individuals seeking an injunction to stop the Malawi Electoral Commission (MEC) from enforcing certain provisions of the Presidential, Parliamentary, and Local Government Elections Act of 2023.

The group wants court to suspend Section 12 of the Act, which requires the National Identity Card to be the sole identifier for individuals registering to vote in public elections.

They want the court to halt this provision until the matter is resolved.

According to a post on the Ministry of Justice’s Facebook page, Justice Mandala Mambulasa will preside over the case.

Attorney General Thabo Chakaka-Nyirenda is leading the defense, opposing the injunction.

Private lawyer Felix Tambulasi represents the claimants who are George Chipwaila, Geoffrey Banda, Alex Phillip Dimba, James Chitsulo, and Crino Masulani.

Meanwhile, MEC has begun voter registration in selected areas today ahead of the general elections slated for next September.

If the injunction is granted, the registration process will be halted. However, if the application is dismissed, MEC will proceed with the exercise uninterrupted.
