Chilima off the hook: DPP discontinues his case
Vice President Saulos Chilima is now a free man after his corruption case was discontinued.
The Director of Public Prosecutions, Masauko Chamkakala, has exercised his constitutional powers to halt the matter.
The decision by the DPP means the full reclamation of all delegated powers, and lifting of all bail conditions.
However, the ruling by High Court Judge Redson Kapindu specifies that discharging the matter does not prevent Chilima from facing subsequent proceedings within six months from the day of discharge, based on the same facts.
Under Section 99(2)(c) of the Republican Constitution, the DPP has the power to discontinue any criminal proceedings at any stage, before judgement is given.
Nevertheless, the DPP is obligated to submit the discontinuation to the Legal Affairs Committee of Parliament within 10 days, as stipulated by Section 99(3) of the Republican Constitution.
Chilima was arrested in November 2022 for allegedly receiving bribes from UK based businessman Zuneth Sattar to influence the awarding of government contracts.
