MLS faults Ayuba, court rebuffs Chokotho
The Malawi Law Society-MLS has found private practicing lawyer Sylvester Ayuba James guilty of stealing over K11 million from a client.
The MLS disciplinary committee says Ayuba James embezzled the money from Billy Matitha Gama, but failed to provide competent representation.
In a statement, MLS describes his conduct as unprofessional and recommends the Chief Justice to de-bar him from the legal practitioners list.
It also recommends that the Director of Public Prosecutions–DPP should institute criminal proceedings against the legal scholar.
In another development, High Court Judge Jabber Alide has dismissed with costs a case in which lawyer Tamando Chokotho challenged FDH Bank not to sell a house he had put as collateral to his loan.
After failing to settle a K144 million bank loan, Chokotho obtained an interlocutory injunction stopping FDH from selling the facility at a price he deemed less.
