Malawi: man jailed 10 years for sodomy
The Senior Resident Magistrate court in Mzuzu on Friday convicted and sentenced 31-year-old Alpha Mwale, to 10 years imprisonment with hard labour for sodomizing an 8-year-old boy.
Mzuzu Police assistant Public Relations Officer Rose Chipyola says, “The court through state prosecutor Inspector Aubry Maganga heard that, during the months of December 2022 and January 2023, Mwale was having canal knowledge of an 8-year-old boy against the order of nature.”
Reports indicate that Mwale used to entice the boy with money and some snacks.
“However one day the boy broke the news to his twin brother not knowing that their elder sister was listening,” Chipyola explains. “After being shocked with the story she rushed to inform her mother who later reported to Mzuzu Police.”
Appearing before court, Mwale pleaded not guilty to the charge of sodomy contrary to Section 153 (a) of the Penal Code. This promoted the state to parade five witnesses who proved the case.
In mitigation, the convict pleaded for leniency, saying he is the bread winner to his family and also a first-time offender.
However, in his submission, state prosecutor Inspector Maganga prayed for a stiffer punishment, citing that the offence is serious in nature and the victim wil remain traumatized.
Passing the sentence, Senior Resident Magistrate Issah Maulidi accorded with the state’s submission and added that, the offence was against the law, culture and humanity. He therefore, slapped the convict with 10 years imprisonment with hard labour.
Mwale hails from Munkhokwe Village, Traditional Authority Malanda in Nkhata Bay District.
