Zomba Senior Resident Magistrate Court recently convicted and sentenced an 18-year-old boy to 13 years imprisonment for defiling a two year old baby girl.
Prosecutor from Jali Police Post in the district, Sub Inspector Kesten Chimwala told the court that on 3rd April, 2019, the victim’s mother went to the market, leaving the victim playing with her friends.
“Yamikani Matiki, who is a neighbor to the baby’s family took advantage of the mother’s absence and took the victim behind his house where he defiled her,” said Chimwala.
The matter was reported to Jali Police Post and later was referred for medical examination whose results proved that the baby was defiled, according to Sub Inspector Chimwala.
He further told the court that the police arrested Matiki and charged him with the offence of defilement which is against section 138 (1) of the penal code.
Matiki who comes from Lepo Village, Traditional Authority Mwambo in Zomba pleaded guilty on defilement charges that were leveled against him.
Chimwala asked the court to give Matiki a stiffer and custodial sentence saying what he did was inhuman.
In mitigation, Matiki apologised for his action and asked the court not to give him a stiff punishment.
Senior Resident Magistrate Rhodrick Michongwe said it is the duty of the court to protect children.
He further said the victim was physically and psychologically tortured and the convict deserved a stiff sentence.
